These Terms of Service (“Terms”) form a binding agreement between you and Vocable (“Vocable,” “we,” “us,” or “our”) and govern your use of the Vocable mobile application and related services (together, the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
These Terms incorporate Apple’s Standard EULA for App Store users, except where these Terms provide otherwise.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA / UK) to use the App. If you are under the age of majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Licence to use the App
Subject to your compliance with these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, non‑sublicensable, revocable licence to install and use the App on devices you own or control, solely for your personal, non‑commercial use.
You agree not to:
- copy, modify, adapt, translate, or create derivative works of the App;
- reverse engineer, decompile, or disassemble the App, except where this restriction is prohibited by applicable law;
- remove or alter any proprietary notices;
- use the App to violate any law or third‑party right;
- interfere with the operation of the App, attempt to gain unauthorised access, or use the App to transmit malware;
- use automated means to access the App or extract data from it.
3. Your account
If you choose to create an account for cloud sync, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@dailyvocable.com if you suspect unauthorised use.
4. Subscriptions
Some features of the App (“Premium Features”) are available only with a paid subscription (“Vocable Premium”). The following terms apply to subscriptions purchased through Apple’s App Store or Google Play.
4.1 Subscription title and content
- Title: Vocable Premium
- Length: Annual (12‑month) auto‑renewing subscription
- What it unlocks: Unlimited daily reviews, all available languages, advanced statistics, cloud sync, and access to future Premium‑only content released during your subscription period
4.2 Pricing
The price of Vocable Premium is shown in the App at the point of purchase, displayed in your local currency. Prices may vary by region and may change. Any price change will not affect a subscription period you have already paid for, and we will notify you before the change takes effect.
4.3 Free trial
If we offer a free trial, the duration is shown in the App at the point of sign‑up. The free trial automatically converts into a paid subscription unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
4.4 Billing and auto‑renewal
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- Subscriptions automatically renew at the end of each billing period at the then‑current price unless cancelled at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
4.5 Managing and cancelling
You can manage and cancel your subscription at any time:
- iOS / iPadOS: Settings → [your name] → Subscriptions → Vocable
- Android: Play Store → Profile → Payments & subscriptions → Subscriptions → Vocable
Cancellation takes effect at the end of the current billing period; you will continue to have access to Premium Features until then. Deleting the App does not cancel a subscription.
4.6 Refunds
All purchases are processed by Apple or Google. Refund requests are subject to the policies of the applicable platform:
- Apple — reportaproblem.apple.com
- Google — Play Store refund policy
To the maximum extent permitted by law, payments are otherwise non‑refundable, and we do not provide refunds or credits for partially used periods.
5. Acceptable use
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the App.
6. Content and intellectual property
6.1 Our content
The App, including its design, source code, vocabulary entries, definitions, example sentences, audio, illustrations, logos, and other content (the “Vocable Content”), is owned by Vocable or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the licence granted in Section 2, no rights are transferred to you.
6.2 Your content
If you submit feedback, suggestions, or other materials to us, you grant us a worldwide, royalty‑free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, and distribute that content for the purpose of operating and improving the App. We do not claim ownership of any personal study notes you create on your own device.
6.3 Feedback
We welcome feedback. By submitting feedback, you confirm it is non‑confidential and that we may use it without obligation to you.
7. Third‑party services
The App integrates with third‑party services, including Apple, Google, Supabase, and RevenueCat. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content, products, or services of any third party.
8. Privacy
Our Privacy Policy describes how we collect, use, and protect your information and is incorporated into these Terms by reference.
9. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non‑infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that the App will be uninterrupted, error‑free, secure, or free of harmful components, that defects will be corrected, or that vocabulary content will be accurate, complete, or up to date. The App is for educational purposes and is not a substitute for formal language instruction.
10. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Vocable, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the App.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD $50.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, the disclaimers and limitations above apply only to the extent permitted by law, and nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Vocable and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your use of the App, (b) your violation of these Terms, or (c) your violation of any law or third‑party right.
12. Termination
You may stop using the App at any time and uninstall it from your device. We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have breached these Terms or that suspension is necessary to protect the App, our users, or third parties. Sections 6, 9, 10, 11, and 14 survive termination.
13. Apple‑specific terms
If you obtained the App from the Apple App Store, the following additional terms apply:
- These Terms are between you and Vocable only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defence, settlement, or discharge of any third‑party claim that the App or your use of it infringes intellectual property rights.
- You must comply with all applicable third‑party terms when using the App.
- Apple and Apple’s subsidiaries are third‑party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you.
14. Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will notify you in the App or by email before the change takes effect. Your continued use of the App after a change becomes effective constitutes acceptance. If you do not agree to the changes, you must stop using the App.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction where Vocable is established, without regard to conflict‑of‑laws rules. Disputes shall be resolved in the courts of that jurisdiction, except where applicable consumer law grants you the right to bring proceedings in your country of residence.
16. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Vocable regarding the App.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
